This legal notice contains the general terms and conditions governing access to and use of this website, hereinafter “the website”. Use of the website implies express and full acceptance of these general terms and conditions in the version published at the time it is accessed by the user, without prejudice to any particular terms and conditions that may apply to some of the specific services available on the website.                                                                                                            

Access to the website is free of charge except for the cost of the telecommunications network connection provided by the access provider contracted by users. Certain services are for the exclusive use of our customers and their access is restricted. 

Use of the Portal attributes the status of Portal user (hereinafter, the ‘User’) and implies acceptance of all the terms and conditions contained in this Legal Notice. The provision of the Portal service is limited to the time in which the User is connected to the Portal or to any of the services provided thereon. Therefore, the User must carefully read this Legal Notice each time they intend to use the Portal, since the Portal itself and the terms and conditions of use contained in this Legal Notice may be subject to change.

Certain Portal services available to Internet users or exclusive to Grupo Alsur’s customers may be subject to particular terms and conditions, regulations and instructions which, if applicable, replace, complete and/or modify this Legal Notice and which must be accepted by the User before the corresponding service is provided.

2. Intellectual and industrial property

This website and its contents are protected by current intellectual property regulations. 

Grupo Alsur is the owner or licensee of all the intellectual and industrial property rights of its website, as well as of the elements contained thereon. Therefore, the reproduction, distribution, public disclosure and transformation of all or part of the contents of this website, for commercial purposes, in any format and by any technical means, without the authorisation of Grupo Alsur, is expressly prohibited. 

The trademarks, trade names or distinctive signs are owned by Grupo Alsur, either by industrial or intellectual property. Under no circumstances does access to the Portal attribute any right over the aforementioned trademarks, trade names and/or distinctive signs.

All products and services on this website that are NOT owned by Grupo Alsur are registered trademarks of their respective owners and are recognised as such by our company. They only appear on Grupo Alsur’s website for promotional and information gathering purposes. These owners may request the modification or deletion of the information belonging to them.

3. Terms and conditions of use of the portal

3.1 General

The User undertakes to make correct use of the Portal in accordance with the Law and this Legal Notice. The User will be liable to Grupo Alsur or to third parties for any damages that may result from non-compliance with this obligation.

It is expressly forbidden to use the Portal for purposes that may be detrimental to the property or interests of Grupo Alsur or those of third parties, or that in any other way overload, damage or disable the networks, servers and other computer equipment (hardware) or products and computer applications (software) belonging to Grupo Alsur or third parties.

3.2 Contents

The User undertakes to use the Contents in accordance with the Law and this Legal Notice, as well as with any other terms and conditions, regulations and instructions that may apply in accordance with the provisions of clause 1.

By way of example, in accordance with current legislation, the User must not:

• Reproduce, copy, distribute, make available, publicly disclose, transform or modify the Contents, except in cases permitted by law or with the express consent of Grupo Alsur or that of the owner of the exploitation rights, as applicable.
• Reproduce or copy Contents that may be considered as Software or as a Database for private use, in accordance with current intellectual property regulations, as well as their public disclosure or provision to third parties when doing so necessarily implies reproduction by the User or a third party.
• Extract and/or reuse all or a substantial part of the Portal Contents as well as the databases made available to Users by Grupo Alsur.

3.3 Inclusion of links on the Portal

If an Internet user wishes to include links from their own website to the Portal, they must comply with the terms and conditions listed below. Under no circumstances will lack of knowledge of such terms and conditions exempt them from the liabilities derived by Law:

• The link may only connect to the home page or main page of the Portal and must not reproduce it in any way (online links, copy of texts, graphics, etc.).
• In accordance with the applicable legislation in force at any given time, it is forbidden to establish frames of any kind that surround the Portal or that enable the Contents to be viewed through Internet addresses other than those of the Portal or, in any case, when viewed with contents unconnected to the Portal in such a way that: (I) generates, or could generate, error, confusion or deceit in users as to the true origin of the service or Contents; (II) involves an act of unfair comparison or imitation; (III) serves to take advantage of the reputation of the brand and prestige of Grupo Alsur; or (IV) is prohibited by current legislation in any other way.
• No false, inaccurate or incorrect statement must be made about Grupo Alsur, its partners, employees, customers or about the quality of the services it provides by the page including the link.
• Under no circumstances will it be stated on the page containing the link that Grupo Alsur has given its consent to include the link or that it sponsors, collaborates with, verifies or supervises the services of the sender in any other way.
• The use of any word, graphic or mixed trademark or any other distinctive sign belonging to Grupo Alsur on the sender’s page is prohibited except in cases permitted by law or expressly authorised by Grupo Alsur and provided that, in such cases, a direct link to the Portal is permitted in the manner established in this clause.
• The page establishing the link must abide faithfully by the law and must not, under any circumstances, provide or link to first-party or third-party contents that: (I) are illegal, harmful or contrary to morality or decency (contents that are pornographic, violent, racist, etc.); (II) mislead or could mislead the User into thinking that Grupo Alsur backs, endorses, adheres to or in any way supports the legal or illegal ideas, statements or expressions of the sender; or (III) are inappropriate or irrelevant to the activity of Grupo Alsur in view of the place, contents and subject matter of the sender’s website.

4. Exclusion of liability

4.1 With regard to information

Grupo Alsur will not be held liable for decisions taken on the basis of the information provided on the Portal or for any damages caused to the User or third parties as a result of actions based solely on the information obtained on the Portal.

4.2 With regard to the quality of service

Access to the Portal does not imply any obligation on the part of Grupo Alsur to control the absence of viruses, worms or any other harmful computer element.                                                                                                                           

In any case, it is the User’s responsibility to ensure the availability of adequate tools for the detection and disinfection of harmful computer programmes.

Grupo Alsur will not be held liable for any damage caused to the computer equipment of Users or third parties during the provision of the Portal service.

4.3 With regard to the availability of the service

Access to the Portal requires third-party services and supplies, including transport through telecommunications networks, the reliability, quality, continuity and operation of which is not the responsibility of Grupo Alsur. Therefore, the services provided through the Portal may be suspended, cancelled or become inaccessible, prior to or during the provision of the Portal service. 

Grupo Alsur will not be held liable for damages of any kind caused to the User as a result of failures or disconnections in the telecommunications networks that lead to the suspension, cancellation or interruption of the Portal service during or prior to its provision.

4.4 With regard to contents and services linked through the Portal

The Portal access service includes technical linking devices, directories and even search tools that allow the User to access other Internet pages and portals (hereinafter, ‘Linked Sites’). In such cases, Grupo Alsur acts as an intermediary service provider in accordance with article 17 of Law 34/2002, of 12 July, on Information Society Services and Electronic Commerce (LSSI) and will only be responsible for the contents and services provided on the Linked Sites if it has effective knowledge of their unlawful nature and has not deactivated the link with due diligence. If the User considers that there is a Linked Site that contains unlawful or inappropriate contents, they may notify Grupo Alsur in accordance with the procedure and effects established in clause 6, without this notification entailing the obligation to remove the corresponding link.

Under no circumstances will the existence of Linked Sites presuppose the existence of agreements with the managers or owners thereof, nor the recommendation, promotion or identification of Grupo Alsur with the statements, contents or services provided.

Grupo Alsur is not aware of the contents and services of the Linked Sites and therefore will not be held liable for damages caused by the unlawfulness, quality, lack of updating, unavailability, error and non-usability of the contents and/or services provided by the Linked Sites or for any other damage that is not directly attributable to Grupo Alsur.

6. Communication of unlawful and inappropriate activities

If the User or any other Internet user becomes aware that the Linked Sites connect to pages with contents or services that are unlawful, harmful, degrading, violent or contrary to morality, they may contact Grupo Alsur, indicating the following information: 

1. Personal data of the communicating party: name, address, telephone number and email address.
2. Description of the facts that demonstrate the unlawful or inappropriate nature of the Linked Site.
3. In the case of the infringement of rights, such as intellectual and industrial property rights, the personal data of the holder of the infringed right, where it is a different person to the communicating party. 
4. A certificate accrediting the legitimacy of the holder of the rights must also be provided and, where applicable, a certificate accrediting the right to act on behalf of the holder, where it is a different person to the communicating party.
5. Express declaration that the information contained in the claim is accurate.

Receipt of the communication described in this clause by Grupo Alsur will not imply effective knowledge of the activities and/or contents indicated by the communicating party, in accordance with the provisions of the LSSI.

A certificate accrediting the legitimacy of the holder of the rights must also be provided and, where applicable, a certificate accrediting the right to act on behalf of the holder, where it is a different person to the communicating party.

7. Notifications

All notifications and communications made by the parties will be valid in accordance with the means permitted by law. Those related to this Portal will be deemed to have been effectively made, for all purposes, when sent through the Portal itself.

8. Modifications

Grupo Alsur reserves the right to make any modifications it deems appropriate to its website without prior notice, being able to change, delete or add both the contents and services provided and the way in which they are presented.

These terms and conditions may also be subject to change at any time. Such modifications will enter into force as soon as they are published.

9. Social media

Grupo Alsur is present on various social networks and platforms. Therefore, when accessing them or any other networks, it should be taken into account that the terms and conditions of use established by each platform apply, for which Grupo Alsur has no responsibility.

10. Legislation

This Legal Notice is governed in each and every one of its aspects by Spanish law. Provided that the established legal jurisdiction can be waived by applicable law, the courts of Malaga are designated as the jurisdiction to settle possible disputes, and the user expressly waives any other applicable jurisdiction.
